Subject: Electronic Conveyance Of Title Of Property
It is recommended that the Commission authorize the Commission’s General Counsel or Manager – Property Development to execute any and all documents which bind the Commission when electronically registering any document in the Ontario Land Registry Office related to a grant, sale, transfer and/or disposition of title to real estate properties, or any parts thereof.
There are is no funding implications with respect to this report.
At the Commission meeting of March 24, 2004, the Commission approved Report No. 21, which authorized the City of Toronto Legal Division, designated by the City Solicitor, subject to the approval of TTC General Counsel, to electronically register land transfer and registration documents in the Ontario Land Registry Office for the sale and/or transfer of title for real estate properties and to include the statement, where required, that they (City Solicitor or his/her designate) have authority to bind the Commission.
In addition to the previous authority granted at the Commission meeting of March 24, 2004, The City of Toronto Legal Division has now recommended that an additional authority to execute electronic registration documents and bind the Commission be provided to TTC General Counsel and/or Manager – Property Development. This will allow the City Solicitor, or his/her designate, to rely upon the authority provided by TTC General Counsel and/or Manager – Property Development when executing any electronic registration form which requires the City Solicitor, or his/her designate, to include a statement indicating that he/she has authority to bind the Commission.
In order to allow for the City Solicitor, or his/her designate, to properly execute any electronic registration form with respect to the conveyancing of property in Ontario, the City Solicitor, is required to indicate that it has authority to bind the Commission. As such, the City Solicitor requires that authority be provided to TTC General Counsel and/or Manager – Property Development to execute an electronic registration form advising that the City Solicitor has the authority to bind the Commission.
